Would that go to civil or criminal court?
I think they can take her to court if they don’t get their last paychecks o.o

If they take her to court to get their checks, they have to pay a lawyer. It may not be worth it — unless she doesn’t have the money, in which case it is definitely not worth it.
Small claims court? Workman’s lien? If the Art Box was not organized as a corporation or Subchapter S they could go after Carol’s personal assets, assuming she has any.

Lawyers in these cases generally take a percentage, so you end up with a net gain.
Probably two weeks pay, so small claims court; so no lawyer needed. They do need to find Carol, to subpena (sp?) her. And maybe she has no available assets. Their best hope is to get on one of those TV courts, those pay the damages.

Sadly, this comic brought back memories. Yeh, been there, experienced that. Court cases notwithstanding, Randie’s hands are pretty much tied. Well, unless Carol decides to make a reappearance.
In California, the labor law code says that until an employee receives their pay they remain employed AND continue to draw their pay. If you take a week to pay, you have to pay an extra week’s wages. There are clauses for triple damages as well. This can add up to a significant sum, and there are plenty of lawyers ready to take on a group of unpaid employees because of the damages clauses which generate enough of a pay-out to pay the lawyers as well as fully repay (or more) the employee the wages they are due.
I don’t know how these laws apply when a business goes BK though.

First Carol must be found in order to set things right. If she ain’t around, they’ll be no squeezing blood from a turnip. Vegas is a big town… and perhaps her time in Vegas didn’t help things much.
Carol (& This situation) is not based on anyone I know personally… but there was a business in Carmel that suffered something like this not long ago. It was a well-known and loved place… and the outcome, thankfully, ended well… or as best it could. I think it ended well. The entire staff was rehired at the new establishment… save one, the owner.
Randie isn’t the “go after them with a lawyer” type. She’d most likely move on and hope that it gets resolved. Don’t expect her to try to take up law to get her pay here.
